After being arrested by the Federal Police in the condominium where he lived in Santos, on the coast of Sao Paulo, Robinho underwent a custody hearing and was transferred to the Tremembé II penitentiary in the early hours of Friday. For a period of ten days, The man convicted of rape is under observation in a 2×4 meter cell, designed for this purpose, with capacity for two people. He is currently alone in his cell.

Robinho was arrested by the PF in the condominium where he lives, on the outskirts of Santos, in the early evening of last Thursday 21st. Earth they followed the movements of the police officers, who remained in the building for about an hour before leaving in unmarked vehicles.

Robinho was then taken to the PF headquarters in Santos, where he underwent a criminal examination and a custody hearing via video conference. From there the transfer to Tremembé was authorized by the Judiciary.

The movement to arrest the player began on Thursday afternoon, when STJ president, Minister Maria Thereza de Assis Moura, signed a letter to the Federal Court of Santos ordering the issuance of an arrest warrant against Robinho. The decision was followed by federal judge Mateus Castelo Branco Firmino.

Minister Luiz Fux, of the Federal Court (STF), however rejected the request habeas corpus presented a petition by the former player’s defense. In the decision, the minister argued that, by approving the sentence, the STJ respected the international cooperation agreements between Brazil and Italy.

According to Fux, Robinho responded to the case duly represented by a lawyer and was finally convicted by the Italian court.

Last Wednesday, the 20th, the STJ magistrates approved the sentence of the Italian Court, which sentenced the former player to nine years in prison. The sentence will have to be served in a first closed regime, in Brazil. The trial score was nine ministers in favor and two against the decision.

The STJ also decided to arrest Robinho immediately, contrary to another wing which argued that the arrest should only take place after the final sentence had been issued, i.e. after all resources had been exhausted.

According to the ministers, Robinho must remain in a closed regime because the crime is considered serious and carries a sentence of more than eight years. Issues related to the progression of the punitive regime must follow the norms of the Brazilian Law on Atrocious Crimes and the Law on Criminal Executions.
