Daniel Alves leaves prison in Spain after paying R$5.4 million bail

It took the defense five days to raise the sum as legal issues limited access to the assets of the player, who was sentenced to four and a half years in prison for rape

Daniele Alves left the Brians 2 prison complex, in Barcelona, this Monday, after his defense paid a bail of around 1 million euros to the Spanish court to obtain bail. The player, 40, who maintains his innocence, had been in pre-trial detention since January 2023 and was sentenced to four and a half years in prison on 22 February this year for the rape of a young woman in a nightclub in Barcelona , in December 2022.

The release was finalized after the defense lawyer, Inés Guardiola, went to prison and finalized the procedures. She arrived accompanied by Bruno Brasil, a friend who was with the former Brazilian national team player on the night of the rape. To leave Brians 2, the full-back and his companions had to endure a protest which took place at the entrance of the premises, carried out by the prison staff to ask for greater security in the Spanish prison system, after the cook of the penitentiary Mas d’Enric, El Catllar, being killed by an inmate.

During the period of provisional release, Daniel will keep his Spanish and Brazilian passports, to ensure he will not leave the European country. He also pledged to appear in court every Friday. Before his conviction, the Brazilian athlete had had five requests for freedom rejected due to “risk of flight”.

The player’s representatives have had difficulty collecting the bail amount, as legal issues limit access to his fortune. The Spanish newspaper reports it BrandDaniel Alves’ total assets amount to 55 million euros (R$ 294.6 million).

The Spanish press even reported that there would be financial help from Neymar’s father, who spoke openly about the issue. “They are speculating and trying to associate my name and that of my son with an issue that is no longer our responsibility today,” he said. Previously, at the beginning of the trial, the family of the Al-Hilal player and the Brazilian team had already paid a fine of 150 thousand euros (about 800 thousand reals) as a mitigation of Daniel’s sentence.

The defense, led by lawyer Inés Guardiola, hopes to obtain the release of the sum of 1.2 million euros (around R$6.5 million) that the player will have to receive from the Spanish Ministry of Finance. Second The Vanguardhowever, this was not the origin of the payment.

After the conviction of the Court of Barcelona, Daniel Alves’ case will still be evaluated by the Superior Court of Justice of Catalonia (STJC). Both parties can appeal to the Supreme Court of Madrid, the highest body of Spanish justice. Provisional freedom therefore does not mean that he has been acquitted, but only that he will be able to await the final sentence outside prison. The victim’s lawyer classified the decision as a “scandal” and promised to appeal.

Despite the conviction, Daniel Alves was still in pre-trial detention as the case is being processed with requests for resources. Spanish legislation provides that this type of imprisonment can last up to two years and the player could, therefore, have his sentence extended up to, at most, half the sentence. According to the Court’s interpretation, it is unlikely that a final decision will be reached during this period. The bail imposed is significantly higher than that proposed by the defense, which proposed a bail of 50 thousand euros (R$ 273 thousand).
