STF Minister Luiz Fux maintains the arrest order for Robinho, sentenced to nine years; The Court accepted the detention in Brazil this Wednesday (20)
The Minister of the Federal Court (STF), Luiz Fux, rejected on Thursday (21) the habeas corpus request presented by his defense lawyers against Robinho. Thus continues the arrest of the former player for rape committed in Italy, a country whose court convicted him in 2022. The journalist Andréia Sadi of Globo News was the first to report it.
According to Fux’s reasoning, the sentence has already become final and unappealable in Italy. Furthermore, it is highlighted that Robinho’s arrest in Brazil, even in the face of a crime committed in Italy, is not unconstitutional. The Italian court asked the STF itself that the former Santos and Brazilian national team striker serve his sentence in Brazil.
Last Wednesday, in fact, the Court formed a majority for Robinho to serve his nine-year sentence in Brazilian territory. In 2013 he was involved in the gang rape of a 22-year-old Albanian woman, in a nightclub in Milan, at the time she was still playing for Milan. Although tried in absentia in 2017, he had already received the sentence. After the defense appealed, the final instance confirmed the sentence.
Brazilian law does not allow the extradition of citizens tried abroad, but the Italian court called for Robinho’s arrest in Brazil. With the habeas corpus rejected by Fux, the former player’s arrest could happen at any moment.
