– The Federal Court of Santos, on the coast of Sao Paulo, issued an arrest warrant against former player Robinho after the approval of the sentence imposed on him in Italy for gang rape, validating the fulfillment of the sentence in Brazil.
Previously, the Superior Court of Justice (STJ) had sent the request for prison execution.
The expectation is that the former player’s defense will express the possibility that he will hand himself in directly to the Federal Police Headquarters, instead of being taken from home by the agents.
Once there, the former athlete will have to undergo a criminal examination and a custody hearing before being sent directly to the penitentiary. He should not be held in a temporary detention center, as the order concerns a final sentence, even if in another country.
For security reasons, the destination prison is not announced before the inmate arrives at the unit. However, he is expected to be taken to Tremembé prison, which traditionally houses “high profile” prisoners.
The STJ decided this Thursday (20th), by nine votes to two, to transfer the sentence to Brazil and to immediately begin serving it in a closed regime.
Robinho’s lawyers have filed a habeas corpus application with the Federal Supreme Court (STF) to prevent the arrest until all appeal options are exhausted. Minister Luiz Fux has been chosen as rapporteur, but has not yet spoken.
